RE:  H.O.A. Update

Dear Neighbors:

I am writing you this letter on behalf of the Waterview Property Owners Association, Inc. and the Co-Trustees of the Section 94 Land Trust, Francis J. Colosimo and James R. Colosimo.  I would like to take this time to get everyone caught up to speed on what is happening in Section 94 of South Gulf Cove.

Community Update:

             1.)Charlotte County has recently started the street re-paving inside of Section 94 which will give our streets                                a much needed face lift.  The work should be completed by mid to late summer.
             2.)We currently have four new homes under construction and another three or four in permitting right now.                                 The Board of Directors extends a warm welcome to our new neighbors.
             3.)Two property owners have permitted and built boat docks along the Santa Cruz Waterway with required                                    County, State, and Federal approvals and permits.  Happy Boating!
             4.)Sales have been slower than usual for this time of year, but we do have three pending sales and a couple of                          closed sales to report for real estate activity.
             5.)The voting procedure for amending the Declaration of Covenants and Restrictions for Section 94 has been                             amended.  The Co-Trustees of the Section 94 Land Trust, as the successor Developer, will continue to have                            the authority to amend the Declaration until control of the Association is turned over to the lot owners.                                    After  that time, a majority of the members voting at a meeting of the Association may amend the Declaration,                           so long as a quorum is reached.  If members choose not to attend the meeting, either in person or by proxy,                           then their vote will not be counted in determining whether an amendment is passed.  A copy of this                                          Amendment is enclosed.
             6.)Property owners abutting the greenbelt are not allowed to clear, fill, or improve the greenbelt in any way                                 without prior written approval from the ECC and all county, state and federal agencies involved.  The                                        greenbelt is deemed environmentally sensitive land which may require county, state and federal permits, so                           that it can be cleared.

Areas of New Business:

           1.)The Co-Trustees would like to refer to Section 94 as “Waterview Preserve” which we feel will give the                                      community some needed identity.  This is compatible with the Waterview Property Owners Association, Inc.                             name, so it should not cause any confusion amongst the property owners.
           2.)The Co-Trustees will hold an open workshop to share some of the ideas we are considering for improving                               the community’s common properties, and to receive vital feedback from you the property owners. The Open                           Workshop is scheduled for March 20, 2007 at 6:00 p.m. located at the Pavilion in South Gulf Cove off                                          Ingraham Blvd.  As you can see on the enclosed conceptual drawing, some of the projects we are                                              considering include: 

                                           a.Nature trails in and along the greenbelt.
                                           b.Two lakes to be placed in the greenbelt.
                                           c.Community boat ramp.
                                           d.Tennis courts.
                                           e.A pier.
                                           f.Community center/clubhouse.
                                           g.Pavillion and picnic areas.

           3.)Enclosed is a return survey sheet for you to show your level of interest regarding several of the things                                    illustrated on the enclosed conceptual drawing.  The results and feedback will be presented at the next                                   Board meeting.  The Board thanks you in advance for your participation.
           4.)Several lot owners have inquired into constructing [individual or single] docks on the waterways                                               surrounding Waterview Preserve.  The Board of Directors is considering adopting the enclosed policy,                                    procedures and property criteria pertaining to the construction of docks in Waterview Preserve.

The Board of Directors will hold the next Board Meeting on March 27, 2007 at 6:00 p.m. located at the American Legion 3436 Indiana Rd. Dear Neighbor:

I am writing to you because you own property in Port Charlotte subdivision, Section 94, which is also known as South Gulf Cove. The purpose of this letter is to inform you of some recent developments with respect to Section 94.

Being a Co-Trustee of Section 94 Land Trust, which is an investment group who recently purchased a substantial portion of Section 94, South Gulf Cove. I am also a licensed real estate agent with Downing-Frye Realty, Lie., located in South Gulf Cove at 8300 Wiltshire Drive, Suite 5, plus I am an investor in the Section 94 Land Trust. The Section 94 Land Trust acquired 260 lots, 2 commercial tracts and the 143 acre common greenbelt. hi addition, the Section 94 Land Trust-acquired certain rights and obligations reserved by the original "Developer" of Section 94 pursuant to the recorded covenants and restrictions for the subdivision. Among these rights and obligations is the authority to control the homeowner's association for Section 94, which is called the Waterview Property Owners Association, Inc. By virtue of your ownership of a lot in Section 94, South Gulf Cove, you are a member of this organization. Please note that this homeowner's association is separate and distinct from the South Gulf Cove Homeowners Association, Inc.

At this point, the Board has elected to hold its first board meeting to discuss the proposed budget for maintenance and clean up of the common area, among other things.

                                                         Where: American Legion on Rotunda Blvd, East
                                                         When:   March 14, 2006
                                                         Time:    Meeting will start at 7:00 p.m.
                                                         Estimated cost of maintenance and clean up is $300 per lot.
                                                         All lot owners are welcome to attend.

We strongly believe that Section 94 has the potential of becoming the most desirable property in South Gulf Cove. Our goal is to invest in improving property values in Section 94 for ourselves and our neighbors and then give control and management of the Waterview Property Owners Association over to the new Board of Director elected by you, the lot owners.
